In the following lines, we will inform you about the personal data that we need to issue and maintain a Swiss Boutique Club Card.

Defining the concepts

Personal data – personal data is any information relating to an individual who is identified or identifiable, directly or indirectly, by reference to an identification number or to one or more specific attributes. These are your name, email address, phone number that you use as our contractor.

About the Swiss Boutique Club Card service

Basic services – we offer a club card to all customers who make a certain number of purchases in our Swiss Boutique stores. Upon your consent, each subsequent purchase is registered to your card.

Customer account – the issuance of a Swiss Boutique Club Card consists in the creation of a registration in our trading system. For this purpose you provide the following data – name, email, phone number, date of registration.

Additional services

Advertisement – any statement in the conduct of a trade, business, etc. for the purpose of promoting the sale of goods or the performance of services, including real property, rights and obligations. Our advertising covers our own products, goods or services. The information channels we use are: email, newsletter, Facebook, Adwords, Twitter, Instagram, flyers, media advertising, etc.

Invitations to purchase and special offers – we use your personal data, primarily email addresses, to send you offers that we think may be of interest to you. Once sent, offers are anonymised and cannot be linked to their recipient in any way.

Campaigns – we periodically organize campaigns for our loyal customers. You will get information about them from our advertisement.

By registering a card, you receive a customer card number that identifies your personal data, as this number allows for a definitive identification of your identity. It is important to know that your personal data is not visible to the employees of 212 Ltd. Only our authorised data controllers have access. You can receive informational and promotional messages from us at the phone number and email.

The data processing is based on Art. 1(a) of the General Data Protection Regulation and serves the performance of the contract.

Processing of personal data for the purpose of receiving advertising

Non-personalised advertising

In order to send you information and advertising about current products, services, games with prizes, and campaigns, the following personal data is required:

The data processing is based on Art. 7 of the General Data Protection Regulation and serves to receive non-personalised advertising.

Personalized advertising

In order to send you information and advertising about relevant products, services, games with rewards and campaigns that meet your personal interests, we analyse your purchasing behaviour, your participation in our promotional campaigns and your user behaviour when using our electronic media. For this purpose, we need to process the following personal data:

name and surname
email

In order to only send you news that matches your interests, we need to personalize your data. To this end, we analyse the following data:

name and surname, sex.
Buying behaviour data – products, product category, use of offers and campaigns when purchasing goods/products, classification into categories with criteria, length of visit and finding similarity to our other customers by criteria.

The data processing is based on Art. 1 (a) of the General Data Protection Regulation and is used to receive personalised advertising.

Processing of personal data for the purpose of personalised data assessment

If you have given us your consent to do so, we will evaluate your user behaviour by automatically processing your personal data about your purchasing behaviour. We will store your information about your purchasing behaviour and link it to your personality. Through this data processing, we want to target our services to your interests and optimize them for you. Again, we would like to assure you that all personal data is encrypted and is not accessible to the employees of 212 Ltd, but only to our data controllers.

To this end, we evaluate the following data:

Data on purchasing behaviour – products, product category, use of offers and campaigns when purchasing goods/products, classification into categories with criteria, duration of visit and finding similarity to our other customers by criteria.

Data processing is based on Art. 22 para. 2 lit. c, Art. 6 para. 1 lit. a, Art. 7 GDPR and serves for a personalized data evaluation. With regard to the processing of this data, we draw your attention to the additional rights you have under clause 10.7.

Processing of personal data for market research purposes

We process your personal data for market research and opinion purposes. In doing so, your data is anonymised, is only used by us for statistical purposes and can at no time be linked to you. You may object to the processing of your data at any time and without giving reasons.

The data processing is based on Art. 1(f) of the General Data Protection Regulation.

Use of services of processors / data processing in countries outside the European Economic Area

“212” Ltd uses the services of data processors for the purpose of processing your data in connection with the Swiss Boutique Club Card. Data processors process data on our behalf and are obliged to comply with the applicable data protection regulations. All data processors are carefully selected and only have access to your data necessary for the provision of the services, to the extent and for the period of time required, or to the extent that you have consented to the processing and use of the data.

If 212 Ltd. chooses service providers that process personal data in countries such as the United States or countries in the European Economic Area, they are subject to data protection law that generally does not protect personal data to the same extent as in European Union member states. If your data is processed in a country that does not have a recognised high level of data protection, such as the European Union, 212 Ltd will ensure that your personal data is adequately protected by contractual provisions or other recognised instruments.

Personal data shall be provided to public authorities, such as authorities for the control of administrative offences or for criminal prosecution, only to the extent permitted by law.

Data security

We take technical and organisational security measures to protect your data from unwanted access as comprehensively as possible. Along with securing the working environment, we use encryption procedure in some areas such as customer account, contact form web page. The information you provide is then transferred in encrypted form using the SSL protocol (Secure Socket Layer) to prevent misuse of the data by third parties. You’ll know this when you see that the padlock symbol is locked in your browser’s status bar and the address bar starts with “https”. Data security shall take into account the relevant current level of technology.

Right to information

You have the right at any time to request information from us about the data stored about you, as well as its origin, the recipients or categories of recipients to whom it is transmitted and the purpose of the storage.

Right of withdrawal

Right to erasure and blocking

If this is the case in your customer account, you will receive a message from us.

Right to data portability (as of 25.05.2018)

If you request your personal data from us, we will transmit or transfer the data to you or another controller in a structured, commonly used and machine-readable format. We will only carry out a direct transfer of data if this is technically feasible.

Right to object

Additionally, we draw your attention to the fact that if you object to any processing of your data, the performance of the club card contract and the implementation of the customer programs may be restricted or no longer possible.

Overview of the purposes of data processing for Swiss Boutique Club Card services

In order to execute the contract and use the customer account, when filling out a paper application, it is absolutely necessary that we receive your first and last name, address, email, phone number and date of birth.

In order for us to be able to contact you with advertising, we need your first and last name and email address.

In addition, we process your basic and user data to improve our products, goods and services and in doing so we classify your interest in our products, goods and services and on this basis we will send you information and suggestions tailored to you.

Your personal data is also processed for market research purposes. But this is done only after full anonymization. Thus, the assessment lacks any personification. There is no possibility to reach a conclusion about your personality.
